Registering the marriage before applying as a child

If your Portuguese parent married in Brazil, that marriage has to be registered in Portugal before you file your citizenship application.

To apply for Portuguese citizenship on the child path, you have to prove that your father or mother is Portuguese. That proof is the birth record issued in Portugal. But the birth record alone may not be enough: if the Portuguese parent married in Brazil and that marriage was never registered in Portugal, the Portuguese civil register has no record of it.

This creates a practical problem. The IRN reviews the file based on what is in the Portuguese civil register. A marriage celebrated in Brazil, apostilled and valid as a document, still does not exist for the Portuguese register if it was never transcribed. When the IRN notices that gap during review, it issues a formal request for more documents. The case stops.

What a marriage transcription is

A marriage transcription is the act by which a marriage celebrated abroad enters the Portuguese civil register. It is not a new recognition of the marriage. It is simply the recording of that event in the Portuguese system, so it appears in the Portuguese citizen's history. From then on, the parent's birth record is updated with an annotation of the marriage.

When the transcription is needed

The transcription is needed when the Portuguese parent married outside Portugal and the marriage is not yet in the Portuguese civil register. If the parent married in Portugal, there is nothing to do: the marriage is already registered there. If the parents were never married, the transcription does not apply either: parentage is established directly by the child's birth certificate.

How to do the transcription from Brazil

The Portuguese parent can start the process at a Portuguese consulate in Brazil. The core documents are: - the full-text Brazilian marriage certificate, with a Hague apostille - the parent's valid Portuguese ID

The consulate forwards the request to the IRN, which processes the registration. Processing times vary. The recommended order is to do this step before gathering the other citizenship documents, not at the same time. Only once the registration in Portugal is confirmed does it make sense to file the citizenship application.

What if the parents have divorced?

If the Portuguese parent divorced after the marriage, the divorce also has to be annotated in the Portuguese civil register. Check whether it already is: order the parent's birth record from Portugal and see whether the divorce annotation appears. If it does not, the divorce will also need to be registered before you file.

Rafaela, from Curitiba, is the daughter of a Portuguese man who married in Brazil in 1991. Her father lived and worked in Brazil for decades without registering the marriage in Portugal. When Rafaela asked at the consulate about citizenship, the clerk checked her father's record and saw that the marriage was not annotated. Her father started the transcription with the apostilled marriage certificate. A few months later, the annotation was in place. Rafaela gathered the final documents and filed her application with no risk of a request.
